Subsequent correspondence from India affirmed the same position. The Canadian government tried to stop the Indian influx with a continuous passage order-in-council issued 8 Jan. 1908, but it was loosely drafted and successfully challenged in court: British Columbia Reports, XIII, pp. 415-16. A new continuous passage order, underpinned by an amendment to the Immigration Act, was issued on 27 May 1908, and this was followed by a $200 requirement order on 3 June. These orders were directed against Indians and not the Chinese or Japanese who were covered by other legislation or by treaty. This is clearly stated in a memo from the Minister of the Interior of approximately 5 May 1908: Immigration 536999(3). After the passage of a new Immigration Act in 1910, these orders were reissued unchanged as P.C. 920 and P.C. 926.
